Introduction: the methodological pluralism widely practised recently, led to the methodological chaos in civil researches. Specific risks are caused by the attempts to replace the dialectical materialism with the idealism, repeatedly leading to the problem of correlation between the being and consciousness, the base and the superstructure. Purpose: to demonstrate the importance of the dialectical-materialistic approach for the civil researches, especially those dealing with the proprietorship issues. Methods: the formal logic method and the dialectical logic method were used. Results: the civil methodology should take into account the Russian experience, the national traditions and legal ideology, it is inadmissible to transfer the foreign constructions into the Russian law with no proper adaptation. The researches need to keep in mind that the civil relations should be harmonized with the economical ones, however both of them have their own independence and value. Conclusions: the worldview aspect of the methodology is important for researching the civil law issues. The results of the scientist’s work will depend on the type of his understanding of the law. The law and the legal relations are the independent subjects of the scientific abstraction.

ВведениеМы убеждены, что научно-исследовательская работа в области цивилистики может носить действительно научный характер только на материалистической основе. Диалектический материализм является надежной методологической основой исследования сложнейших теоретических проблем гражданского права, о чем свидетельствует богатая и неоднозначная его история.
